The 2016 CXXX Code of Civil Procedure, which entered into force on the 1st of January 2018 introduced significant changes in the divorce proceeding!
Divorce proceedings cannot be initiated in one procedure with the matrimonial property proceedings. This two institutions split from each other.
If the parties cannot account with their common property, in this case the applicant needs to submit two lawsuits to the competent judicial body.
At the same time, to share the matrimonial property, it is not an obligation in every case to do that with initiating legal proceeding.
The ’’action strategy’’ ceases, that one of the pouses submits exclusive application of parental control for delaying property sharing.
